Can Florida?s Medicaid reform plan be the model for the nation?

Quietly, over the past six years, an experiment in providing healthcare for the poor has been playing out in Broward and four other counties around the state. Its basic goal is to relieve the financial pressures of Medicaid on Florida?s taxpayers by turning over poor and disabled patients to private companies, a move lawmakers believe will cut costs.

Conservatives love the Medicaid reform program, pointing to an in-depth University of Florida study indicating that the experiment has lowered costs while not raising consumer complaints. The Legislature has already approved a slightly modified model of the reform to go statewide. At least one national think tank believes it should be a model for the entire country.

Liberals decry the effort as a way to build corporate profits at the expense of the poor. Howard Mallinger, a Sunrise retiree, thinks they?re right. He has two adult sons with mental health problems who are in a Medicaid health maintenance organization. The HMO frequently won?t provide their medications, or is slow to approve them, causing their health issues to spiral out of control, Mallinger says.

One son has been involuntarily committed under Florida?s Baker Act 44 times in the past five years, he says. That often means expensive three-day hospital confinements. ?The joke is on the taxpayer,? Mallinger says.

With state taxpayers spending $21 billion a year on Medicaid and 3.2 million Floridians depending on it for their care, including 270,000 in Broward, the stakes are huge. The UF research shows the pilot has saved the state about $100?million a year, and Florida?s leaders are determined to take the HMO-style reform statewide as early as 2014.

But three serious problems with the pilot could threaten the plan?s statewide success:

??R. Paul Duncan, the professor who led the much-discussed UF study, says he has yet to answer one crucial question: Does the new system cost less because insurers are providing more efficient care or are they simply giving patients less care?

?That is a very big deal,? he says.

Though discussion of the pilot focuses almost entirely on for-profit HMOs, two of the biggest and most successful groups in the program are nonprofit provider service networks (PSNs) paid on the traditional fee-for-service basis that the state is trying to abolish.

??Many hospitals love the pilot, saying they?re satisfied with the payments they receive. But many doctors hate it, citing complaints from their patients and their own low reimbursement rates. The conservative Florida Medical Association, which represents the state?s doctors, adamantly opposes the statewide expansion.

??The presidential election is likely to play a role as well, since the federal government provides more than half the funding for Medicaid. The Republican platform favors letting states do what they want with Medicaid, while the Obama administration is likely to demand major changes before allowing the pilot to go statewide.

Taxpayers? problem

In the last 12 years, Florida?s Medicaid program has grown five times faster than general revenue. It now consumes 30 percent of the state?s budget and keeps growing.

?Medicaid has commandeered the state budget and crowds out our ability to fund other worthwhile priorities, such as our colleges and universities, public safety and transportation,? complains Sen. Joe Negron, R-Palm City.

(AP) ? Authorities drilled through concrete and removed wet soil samples in a modest Detroit-area neighborhood Friday in the latest effort to find the remains of Teamsters boss Jimmy Hoffa, who disappeared in 1975.

There was no immediate sign of human remains, but test results could be ready by Monday, Roseville Police Chief James Berlin said.

"We're not sure if anything is down there. That's what this is all about," Berlin said.

They drilled the concrete floor of a shed attached to a driveway where a recent radar test revealed a shift in the soil. The latest investigation was launched after a man told police that he saw a body being buried under the driveway 35 years ago and "thinks it may have been Jimmy."

Could this search be the one that solves the mystery? Don't get excited: Authorities have already said they don't think the timeline adds up and that it's unlikely Hoffa's body is there. He was last seen July 30, 1975, outside a restaurant in Oakland County, more than 30 miles to the west.

The homeowner, Patricia Szpunar, 72, has lived there since 1988. She said her son uses the 12-by-12 shed to store two workbenches and his motorcycle.

Police detectives appeared two weeks ago and said they may need to search her yard for a dead body.

"I laughed at them," Szpunar said Friday as the work began. "I looked at them and said, 'What? Do you think Jimmy Hoffa is buried in my backyard?' ... They just looked at me, and asked why I said Jimmy Hoffa."

Recently retired Detroit FBI chief Andrew Arena is among the doubters.

"You've got to check it out, but this doesn't sound right," he told The Associated Press. "The working theories that have developed over the years, this really doesn't fit any of those."

Berlin said he's not claiming Hoffa is under the slab, but they are "investigating a body that may be at the location." He said the home may have been owned in the 1970s by a gambler with ties to organized crime.

Feisty and iron-willed in contract talks, Hoffa was an acquaintance of mobsters and adversary to federal officials. He spent time in prison for jury tampering. The day he disappeared, Hoffa was supposed to meet with a New Jersey Teamsters boss and a Detroit mafia captain.

He was declared legally dead in 1982. Previous tips led police to excavate soil in 2006 at a horse farm more than 100 miles north of Detroit, rip up floorboards at a Detroit home in 2004 and search beneath a backyard pool north of the city in 2003.

There were even rumors that Hoffa's remains were ground up and tossed into a Florida swamp, entombed beneath Giants Stadium in New Jersey or obliterated in a mob-owned fat-rendering plant.

Roseville is one of several inner-ring communities that grew quickly as unionized auto factory workers left the city in search of nicer homes and bigger yards.

News of the latest search has brought attention to the mostly working- and middle-class suburb from the curious and naysayers. Slow-moving vehicles have clogged the residential street as camera-wielding neighbors snapped photos for keepsakes.

"I believe it's him. My sister said it is, and she's a psychic," said Mike Smith after ambling up to the home Thursday and shying a bit from the yellow police tape stretched across the driveway.

One local theory that has endured is that Hoffa is beneath the foundation of a downtown Detroit hockey stadium, said 57-year-old Cindi Frank. The daughter of a unionized driver and salesman for a Detroit bakery, Frank remembers conversations about the mobster.

"It was a family thing. Every time we'd go somewhere we'd say, 'Hey, I wonder if Jimmy Hoffa is buried there?' " she said.

Some think the least likely spot for him to turn up might just be the place he does.

"Maybe the most inconspicuous spot might be the place to stash a body or something," said 52-year-old Andrew Kacir, who lives across the street.

The Motherhood Journey

When your daughter becomes a mother things change. I love watching the two of them together. The other day my daughter looked at me and said, ?You know all those times you were worried about me mom and I didn?t understand why? I understand now.?

And there will be more moments of clarity like that, I?m sure.

I think back over the years and remember her when she was three.? She had long dark hair and she was wearing a white night gown. It was summer and the fireflies were out and she wanted to chase them. I sat on the back porch and watched her catching bugs and I swear I remember thinking I wish I could freeze this moment forever.

Then she was eight years old and so excited to meet her new twin brothers. She changed their diapers and fed bottles and even managed to get thrown up on once or twice.? It was a glimpse through a window of time. I knew she would be a great mother and she is.

My daughter?s? next stage was ?I want it my way,? and when she didn?t get it her way?she ran away. She wasn?t allowed to go past the two trees at the end of the driveway and the one time she did, I almost had a heart attack. When I found her across the road hiding behind the church I cried. There?s no scared like the scared you get when you can?t find your child and that?s one of many things I hope she never has to experience as a mom.

Motherhood Means Giving Your Heart Away

Kennedy,? her daughter is only six months old and already she?s learning that being a mom is harder than she ever dreamed it would be. My daughter is an organizer and every night she lays out Kennedy?s clothes for the next day. She gets all the bottles ready and makes sure I have everything I need to care for Kennedy the next day. Right now Kennedy?s environment is limited but as she gets older more variables come into play and my daughter will find she can control less and less. You give this little tiny person your heart and you want to do everything in your power to keep them healthy, happy and safe and the reality is that we can only do so much. God is in control, not us.

I remember praying when my children were very young that I wouldn?t mess up. ?Please, God,? I begged. ?I only get one shot at this. Please help me do it right.?

That wasn?t a very smart prayer, was it? As much as I wanted to be a ?perfect mom? there was no way I could. A smarter prayer would have been, ?Lord help me to see when I have made a mistake and give me the strength not to repeat it.?

When I failed (lost my temper or had a crying fit) it was usually because I let myself stress over silly unimportant things or I failed to get enough rest. Or when I took my eyes off my main goal, which was to raise Christian children in a Godly home, and focused on temporary things like the house being a mess or having enough dirty laundry to sink a battle ship.

A Woman?s World

I remember reading a newspaper column called ?Take your daughter to work,? It was written by a woman who took her young daughter to the office with her to show her what mommy did at the office. At the end of the article it said something like this, ?You can take your daughter to work to see what a career is like, but then take her home and show her what you do there too because more than likely she will have to straddle both worlds.?

That visual image of having one foot in the work place and another at home stuck with me. It?s incredibly hard for mothers to balance our lives when we are living in such a fast paced world.

My daughter is an awesome mother and I am so proud of her that even as I write this my eyes cloud up with tears. I want her motherhood years to be smooth ones but as sure as I know that the grass is green and the sky is blue, I know she will hit some bumps in the road.

And so, dear daughter, straddle your work world and your home world with as much grace and balance as you can but remember, all of us fall short of perfection.

Motherhood is a glorious, complicated journey. Sometimes you may find that even when you do your very best you fall short. Trust in God and always seek His guidance!? I love you Rachel. Enjoy your journey!

Don?t ever hire an unlicensed contractor. Every state requires some form of certification for general contractors and sub-contractors. While these requirements do not guarantee contractor competence, they are legally required. Also, contractors who do not have the necessary licenses probably also do not have sufficient insurance coverage.

Have a no-shoes rule in your home if you have just installed fresh carpeting or wood flooring. Lay down some slippers you can or have areas where shoes can easily be slipped off to provide encouragement to get everyone to take their shoes off. This can go a long way in helping to keep dirt and debris from scratching or staining wood floors or carpeting.

Try installing cheap and efficient LED lights near or in your closets. The dollar stores now carry these lights! Some types of LED lights require one or two screws to install. Others come with double-sided sticky tape. If you buy automatic lights, you can just open the door and the light will turn on.

It's time to turn up the girl power in science

The European Commission's "Science: It's a Girl Thing!" campaign has been retooled.

It's not exactly surprising that males are perceived as more competent in science than females ? but researchers at Yale University were surprised to find that even professional scientists showed evidence of such bias. Now the big question is what to do about it.

"Whenever I give a talk that mentions past findings of implicit gender bias in hiring, inevitably a scientist will say that can?t happen in our labs because we are trained to be objective," microbiologist Jo Handelsman, lead author of a study published in the Proceedings of the National Academy of Sciences, said in a Yale news release. "I had hoped that they were right."

Nope.


Handelsman and her colleagues asked 127 science faculty members from six institutions to review an application from a senior undergraduate student looking for a job as a lab manager. The faculty members were asked to judge how competent the applicant was, how much the student should be paid, and whether they'd be willing to mentor the student.

Each researcher looked at the same application ??but in some cases the applicant was given a male name (John), and in the other cases a female name was assigned (Jennifer), all on a random basis. When the results were analyzed, it turned out that the sight-unseen male applicant was rated more competent than the female. The mean starting salary offer was $30,238.10 for John as opposed to $26,507.94 for Jennifer. Faculty members were more willing to mentor John than Jennifer.

The data showed a disparity whether the demographic category in question was male or female, young or old, tenured or untenured. "The bias appears pervasive among faculty and is not limited to a certain demographic subgroup," Handelsman and her colleagues wrote.

The researchers emphasized that they weren't suggesting the biases were intentional or stemmed from a conscious desire to hold women back. In fact, they found that the faculty members tended to like Jennifer more than John. That sentiment was generally voiced by faculty women as well as faculty men. It's just that the warm feelings for Jennifer "did not translate into positive perceptions of her composite confidence or material outcomes," according to the PNAS paper.

So what is to be done? "Our results suggest that academic policies and mentoring interventions targeting undergraduate advisers could contribute to reducing the gender disparity," the researchers wrote.

The findings suggest that it's not enough to get young women interested in careers in science, technology, education and math, a.k.a. STEM. There needs to be a conscious follow-through by the folks who do the hiring and mentoring.?You can read through the whole study at the PNAS website.

Maybe it shouldn't be so surprising to find out that scientists can be vulnerable to subtle biases, just like other people. Even journalists. Last month, for example, Lund University researchers Daniel Conley and Johanna Stadmark found that far fewer women than men were being invited to write commentaries for the journals Science and Nature.

Conley and Stadmark acknowledged that men tend to outnumber women in scientific fields, particularly at the higher levels, so there's something of a selection effect at work. But they said it was "still fair to conclude that fewer women than men are offered the career boost of invitation-only authorship in each of the two leading science journals." They called on the editors to "extend gender parity for commissioned writers."

Over time, raising the visibility of women scientists (and raising their salaries) will help draw more girls into research and science education. At least that's the idea. Here are a few more efforts that put girl power to work on the science world's gender issues:

'Girl Thing' reloaded: Remember the European Commission program that stirred up a controversy by putting out a glammed-up video about STEM careers for women? Now the EC's "Science: It's a Girl Thing" program is sponsoring a contest for videographers who think they can do better. On the Scientific American website, "Science Goddess" Joanne Manaster explains how to enter. The winning videos will be shown in November at the European Gender Summit?at the European Parliament in Brussels. Three winners will each receive a cash prize of??1,500 ($1,930).

Think locally:?It's worth looking for organizations that are bringing girl power to STEM on the community level. The best example is Sally Ride Science, which thinks globally and acts locally when it comes to getting girls involved in scientific pursuits. The organization, founded by?the late space icon Sally Ride, presents?a series of science festivals for girls?in grades 5 through 8. The next one is coming up?Oct. 27 at Rice University in Houston, with astronaut Wendy Lawrence as the featured speaker. Other organizations involved in girl-power science include?Girlstart in Austin, Texas; and Science Club for Girls in the Boston area.

Women chemists in the spotlight: The Chemical Heritage Foundation's video series pays tribute to seven women who have made their mark in chemistry?? including Stephanie Kwolek, the inventor of bulletproof Kevlar fiber; Paula Hammond, a pioneer in nanotechnology for drug delivery; and Nancy Chang, a successful biotech entrepreneur.?

Celebrating girl power: Today The Mary Sue?is highlighting a series of posters that pay tribute to women scientists such as Marie Curie, Rosalind Franklin and Jane Goodall. And next month, the Royal Society is planning a Wikipedia "Edit-a-thon" to improve the online encyclopedia's articles about women in science. "Female editors are particularly encouraged to attend," the society says. The event in planned in conjunction with Ada Lovelace Day on Oct. 16.

Career Chick Chat: How I found my business network


Do you remember the scene in Shrek (the first movie) when Donkey was making an absolute pest of himself, jumping up and down behind all the fairy-tale creatures, repeatedly, until in the end he wore Shrek down and was picked to go on the quest to find Lord Farquaad?

Hilarious, but not so funny was that this was how I saw business networking for many years.

?I was at a sales conference many years ago, the dinner was over, the speeches were done and we were meant to be ?networking?.?

I can still recall looking across the room and seeing a number of my colleagues gathered around the management team, and rather like Donkey, trying to be seen and impress how clever, witty or capable they thought they were.

I didn?t want to do that. I didn?t know how to do that (what on earth do you say, I wondered?) and frankly, I didn?t think that the end of a long day after a couple of red wines was the time for a best-impression.?

So I chatted for a while and made my excuses.

Which I also did on many a Friday night when the sales team I worked in was headed down the pub to ?network'? with the support staff and technicians who looked after our customers.

I don?t know about you but by Friday night I?m done. I had friends to catch up with, grocery shopping to do, dinner to cook or even some stolen moments in front of the TV to fit in. I?d worked long and hard enough by Friday night and I wanted to go home. ?You need to network? I was told when I declined yet another Friday night invitation and headed off to my life ? now feeling guilty that somehow I wasn?t fitting in everything I needed to do. I also felt incredibly uncomfortable going to ?networking? events where I?d go home with a pile of business cards and no idea what to do with them.

Everyone tells you that it?s important to network.?

And I truly believe it is.?

When you develop deep business relationships, they are an unbelievable and generous source of information, ideas, contacts and even support when things don?t go your way. I thought I was missing out big time. And then one-day I woke up (it wasn't just one-day, but you get the gist!) and discovered that I had an enormous network. I just hadn?t realised it.

I had worked at the one organisation for many years and worked with and for many great people.

I?d had coffee and lunches with them, worked on exciting and successful projects and on others that were stressful and hard work; laughed with them, helped them and been helped by them.?

Along the way my connections with the ?people I worked with? and ?people I met through work? had developed into deep mutually beneficial business relationships (and some into friends ? but that?s another story) ? and hey, presto - I did have a network! It took moving away from the day-to-day contact for me to realise that?s what they were. The clues about how to keep them in my network were in the past ? a coffee here, a lunch there, an occasional email on topics of mutual interest and I was networking. It just took a bit more thought and organisation than when they were sitting in the same office.

The real surprise came when I moved to my next company and realised that it was expected that I would still be keeping up with past colleagues and the last industry I had worked in. Woo Hoo!?

Networking was a legitimate activity I was meant to be doing as part of working in business. I didn?t have to sneak out at lunch time, make excuses or feel guilty! My network has changed as I, and the ?people-I-know? have progressed in our careers, I?ve met new people and my network now extends to people in all sorts of jobs and organisations and many are scattered all over the world. I do attend a couple of formal networking organisations now because I met some new great people that I share interests with - and it's fun. It?s my network ? why shouldn?t it be? And not a donkey in sight!

The standard for determining whether a call should be overturned by replay review, as once explained by former Packers and Seahawks coach Mike Holmgren, is whether 50 drunks in a bar would agree that it was a bad call.

As to the final play from last night?s Packers-Seahawks game, millions of sober people believe that the ruling on the field should have been overturned.? Those millions don?t include the league office ? and they definitely don?t include Seahawks coach Pete Carroll.

?They said that the call was correct, and after review [it] was correct . . . because it was a simultaneous catch,? Carroll said Tuesday, on ESPN 710?s Brock & Salk.? ?So that?s it.? And that?s the NFL who?s in charge of the whole thing.? That?s not the officials on the field, that?s the league office said that.? And so, you know, it?s hard for everybody to accept, but that?s what it is and I don?t care.?

Regardless of whether there was indisputable visual evidence to reverse the touchdown, Carroll seems to think that the call as made on the field was the correct call.

?They were right on the point, looking right at it,? Carroll said of the officials.?? ?Standing right over the thing.? And they reviewed it.? Whether they missed the push or not, obviously they missed the push in there, in the battle for the ball.? But that stuff goes on all time.? They see it, they don?t see it.? That happens with the official officials.? And so the result is they called it, the league backed it up, game over, we win.?

Carroll may feel that way, some of his players may feel that way, and some of the team?s fans may feel that way.? But most objective observers believe it was a bad call, that it should have been overturned, and that the NFL?s stubborn insistence on winning the negotiation with the locked-out officials has created one of the most dubious moments in league history.

Congratulations, NFL.? We can only wonder what the encore will be.

Doctors on Call: What you need to know about thyroid cancer

The thyroid is a butterfly-shaped gland at the front of your neck just below the Adam?s apple. A healthy thyroid is a little larger than a quarter and usually can?t be felt through the skin.

It might be small, but it?s important.

The thyroid, part of the endocrine system, makes hormones that affect heart rate, blood pressure, metabolism, body temperature and weight.

Many people have benign growths or nodules in their thyroids. But the nodules can also be malignant. Thyroid cancer is the ninth most common type of cancer in the U.S., but it is the fastest increasing cancer in men and women. Here are some facts to know about thyroid cancer:

How common is thyroid cancer?

Thyroid cancer accounts for 1 percent of malignancies diagnosed in the United States each year. The American Cancer Society estimates 56,460 new cases of thyroid cancer and 1,780 deaths from thyroid cancer in the United States for 2012. Although the incidence of thyroid cancer has more than doubled over the past 30 years, part of the increase is related to earlier diagnoses now made possible with readily available diagnostic imaging, such as thyroid ultrasonography.

Who is at risk for thyroid cancer?

Thyroid cancer can affect any age group, but appears to be more common in young and middle adulthood. Two-thirds of those diagnosed with thyroid cancer are between 20 and 55 years old. Women are affected three times as often as men. People with a family history of thyroid cancer or a prior history of radiation treatment or exposure (particularly to the head and neck) are also at a higher risk for thyroid cancer.

What are the symptoms of thyroid cancer?

Thyroid cancer may not cause any symptoms at all in its early development. As the cancer grows in size, however, it is likely to cause symptoms, typically developing into a growing nodule or lump, which increases in size over time. The nodules may be seen or felt at the front of the neck. Enlargement or swelling of the neck, enlarged lymph nodes, hoarseness, difficulty swallowing, difficulty breathing and pain in the neck or throat can be prominent symptoms.

What do nodules have to do with cancer?

A thyroid nodule is a lump or growth within the thyroid gland. Thyroid nodules are very common; they are found in 4 to 8 percent of adults on physical examination, and can be seen in 20 to 40 percent of patients via ultrasound. Sometimes thyroid nodules are found incidentally by other tests such as carotid dopplers, CAT scans or MRI?s of the neck and chest. The risk of a thyroid nodule being a thyroid cancer is about 5 percent, though the risk of cancer can be higher if other risk factors and symptoms are present.

How is thyroid cancer diagnosed?

Patients with thyroid nodules that are palpable or approach 1 centimeter in size or larger should undergo a thyroid fine needle aspiration (FNA), which is generally performed with ultrasound guidance. Smaller nodules can also be sampled by FNA depending on location, or are often simply monitored for any size change by a follow-up thyroid ultrasound.

The thyroid FNA uses a very small needle and does not require any sedation or pain medication. A pathologist looks at the specimen under the microscope and determines if the nodule is benign or malignant (cancerous). If the FNA is not able to establish the diagnosis, some patients may need to undergo a surgical biopsy, where part of the thyroid containing the nodule is removed.

How is thyroid cancer treated?

When thyroid cancer has been diagnosed patients are referred to an experienced thyroid surgeon for surgical removal of the gland. During surgery, lymph nodes in the neck may also be removed and tested for cancer cells. Most patients undergo radioactive iodine treatment after surgery to reduce the likelihood of cancer recurrence.

The survival/cure rate for the most common forms of thyroid cancer is excellent and approaches 95 percent with appropriate care.

(AP) ? A former Army recruiter failed to win a fourth reprieve from the U.S. Supreme Court and was executed Tuesday evening in Texas for participating in the shooting death of a woman he and a buddy met 10 years ago at a bar.

Cleve Foster was pronounced dead at 6:43 p.m. CDT, 25 minutes after his lethal injection began and two hours after the high court refused to postpone his punishment. Three times last year the justices stopped his scheduled punishment, once when he was moments from being led to the death chamber.

His attorneys argued he was innocent of the 2002 slaying of Nyaneur Pal, a 30-year-old immigrant from Sudan. They also said he had deficient legal help at his trial and in early stages of his appeals and argued his case deserved a closer look.

Foster, 48, also was charged but never tried for the rape-slaying a few months earlier of another woman in Fort Worth, Rachel Urnosky.

In the seconds before the single lethal dose of pentobarbital began, Foster expressed love to his family and to God.

"When I close my eyes, I'll be with the father," he said. "God is everything. He's my life. Tonight I'll be with him."

He did not proclaim innocence or admit guilt. He did turn to relatives of his two victims, saying, "I don't know what you're going to be feeling tonight. I pray we'll all meet in heaven."

As the drugs began taking effect and while he was repeatedly saying he loved his family, he began snoring, then he stopped breathing.

Three of the nine Supreme Court justices ? Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor ? would have stopped the punishment, the court indicated in its brief ruling.

Last year ? in January, April and September ? the justices did intervene and halted his execution, once only moments before he could have been led to the death chamber.

"It's offensive to us the frivolous appeals that were thrown up at the Supreme Court last minute," said Terry Urnosky, whose 22-year-old daughter's death was blamed on Foster and a partner, Sheldon Hale. "One stay after another, just delaying the closure our families sought."

Urnosky, his wife, and Pal's uncle and aunt stood a few feet away from Foster and watched the execution through a window.

"It's like ripping off a deep scab each time, preventing the wound from being able to start healing," Unrosky said. "Now the wound can start closing."

Maurie Levin, a University of Texas law professor representing Foster, argued the Supreme Court needed to block it again in light of their ruling earlier this year in an Arizona case that said an inmate who received poor legal assistance should have his case reviewed

Foster and Ward were sentenced to die for killing Pal, who was seen talking with the men at a Fort Worth bar hours before her body was found in a ditch off a Tarrant County road.

"I am as certain of Foster's guilt as I can be without having seen him do it," Ben Leonard, who prosecuted Foster in 2004, said last week.

A gun in the motel room where Foster and Ward lived was identified as the murder weapon and was matched to an earlier to Urnosky's fatal shooting at her apartment.

"It wasn't the violent death that both Mary and my daughter experienced," her father said. "I feel it was way too easy, but it is what it is."

Foster blamed Pal's slaying on Ward, one of his recruits who became a close friend. Prosecutors said evidence showed Foster actively participated in her death, offered no credible explanations, lied and gave contradictory stories about his sexual activities with her.

The two were convicted separately, Ward as the triggerman and Foster under Texas' law of parties, which makes participants equally culpable. Pal's blood and tissue were found on the weapon and DNA evidence showed both men had sex with her.

At his trial, prosecutors presented evidence Pal wasn't shot where she was found; that Ward alone couldn't have carried her body to where it was dumped; and that since he and Foster were nearly inseparable and DNA showed both had sex with her, it was clear Foster was involved. A Tarrant County jury agreed, and both received the death sentence. Ward died in 2010 of cancer while on death row.

Foster grew up in Henderson, Ky., and spent nearly two decades in the Army. Records showed court martial proceedings were started against the sergeant first class and he was denied re-enlistment after allegations he gave alcohol to underage students as a recruiter in Fort Worth and had sex with an underage potential recruit. He'd been a civilian only a short time when the slayings occurred.
